The Chief Judge of the Federal High Court, Justice John Tsoho, has denied Justice Binta Nyako’s request to recuse herself from the trial of Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB). Justice Tsoho has instructed that the case be returned to Justice Nyako, considering her the most qualified judge to continue overseeing the proceedings.
A reliable source, who wished to remain anonymous, disclosed the decision to DAILY POST on Friday, citing several reasons for the Chief Judge’s choice. The source noted that Justice Tsoho’s refusal to reassign the case stemmed from key factors, including:
- Two other judges had previously recused themselves from the case.
- The trial has been pending since 2015.
- Justice Nyako has presided over the case for an extended period, making her the most suited to conclude it.
Furthermore, the Chief Judge directed that if Nnamdi Kanu persists in seeking Justice Nyako’s recusal at the next hearing, he must submit a written motion accompanied by an affidavit outlining all grounds for the request.
Justice Nyako had initially withdrawn from the case after Kanu publicly expressed doubts about her ability to impartially conduct the trial, citing a lack of confidence in her judgment.
